1. I agree and consent to The Greater Metropolitan Cemeteries Trust (ABN 89 704 536 022) making images or recordings, whether video, sound, digital or otherwise, of one or both me and/or the minor participant (Images and Recordings) at the Event, and:
- using, publishing or reproducing the Images and Recordings in any form (in whole or in part) and by any medium, including but not limited to third party event broadcasts, social media websites, newspapers, magazines, brochures, television advertisements, promotional videos, websites or other multi-media, for public relations, promotions, commercial and advertising purposes (Promotional Material), without my further consent being necessary; and
- retaining or storing the Images and Recordings (including those incorporated into Promotional Material), in hard copy or digitally, including but not limited to, deposit of the Images and Recordings into a GMCT image library.
2. I agree that the rights granted to GMCT under clause 1 of this Image Consent Form are perpetual and that, unless otherwise advised in writing by GMCT, neither I nor the minor participant will receive any payment, royalty or other consideration (whether monetary or otherwise) from GMCT in connection with the making, use or storage of the Images and Recordings.
3. I agree to GMCT collecting, storing, handling, accessing, managing, transferring, using and disclosing personal information about one or both me and the minor participant, including but not limited to our name, details and image, in connection with the Images and Recordings or the Promotional Materials.
4. I acknowledge and agree that any Promotional Materials that refer to or incorporate me or the minor participant expressly or by implication, are, at the date of publication, made in good faith and are not intended to defame or offend me or the minor participant or bring either me or the minor participant into disrepute.
5. I acknowledge and agree that GMCT may: (i) edit, digitally change, abbreviate and otherwise amend the Images and Recordings in the sole discretion of GMCT; and (ii) publish my or the minor participant’s name in any Promotional Material, without my further consent being necessary.
6. I agree that GMCT is the owner of the copyright in the Images and Recordings and physical Images and Recordings.
7. I release and indemnify GMCT from and against all liability based on any personal, property, residual, re-use or other right that I or the Participant have or may have by virtue of any use by GMCT of the Images and Recordings, and any claim for further consideration or compensation for the Images and Recordings or the rights granted under this Image Consent Form.
I have the full right and legal capacity to sign, and have read, this Image Consent Form prior to signing it.
